This page is used to inform visitors regarding our policies with the collection, use, and disclosure of Personal Information if anyone decided to use our Service.

Services Overview:
The Marketplace is a platform connecting members to traders, retailers, and Rural, for abundant clarity, the Organisation does not provide any services to users other than providing the Marketplace as a platform to transact at their own cost and risk, and other services as may be specifically be notified in writing. The Organisation is not a party to any transaction between you and the third-party sellers, or have any control, involvement or influence over the products purchased by you from such third-party sellers or the prices of such products charged by such third-party sellers. The Organisation, therefore, disclaims all warranties and liabilities associated with any products offered on the Marketplace. Services on the Marketplace are available to only members of our Organisation and are subject to restrictions based on hours and days of third-party sellers.

Terms of Use:
These terms of use (the “Terms of Use”) govern your use of our “STEMS” application for mobile and handheld devices (the “App”). The App is referred to as the “Platform”. Please read these Terms of Use carefully before you use the services. If you do not agree to these Terms of Use, you may not use the services on the Platform, and we request you to uninstall the App. By installing, downloading or even merely using the Platform, you shall be contracting with STEMS and you signify your acceptance to the Terms of Use and other STEMS policies as posted on the Platform from time to time, which takes effect on the date on which you download, install or use the Services, and create a legally binding arrangement to abide by the same.

AMENDMENTS:
These Terms of Use are subject to modifications at any time. We reserve the right to modify or change these Terms of Use and other STEMS policies at any time by posting changes on the Platform, and you shall be liable to update yourself of such changes, if any, by accessing the changes on the Platform. You shall, at all times, be responsible for regularly reviewing the Terms of Use and the other STEMS policies and note the changes made on the Platform. Your continued usage of the services after any change is posted constitutes your acceptance of the amended Terms of Use and other STEMS policies. As long as you comply with these Terms of Use, STEMS grant you a personal, non-exclusive, non-transferable, limited privilege to access, enter, and use the Platform. By accepting these Terms of Use, you also accept and agree to be bound by the terms and conditions.

STEMS - Use of Android App
You agree, undertake and confirm that your use of Platform shall be strictly governed by the following binding principles:
• You shall not host, display, upload, download, modify, publish, transmit, update or share any information which:
• belongs to another person and which you do not have any right to;
• is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, slanderous, criminally inciting or invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatsoever; or unlawfully threatening or unlawfully harassing including but not limited to “indecent representation of women” within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986;
• is misleading or misrepresentative in any way;
• is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, paedophilia, racism, bigotry, hatred or physical harm of any kind against any group or individual;
• harasses or advocates harassment of another person;
• involves the transmission of “junk mail”, “chain letters”, or unsolicited mass mailing or “spamming”;
• promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
• infringes upon or violates any third party’s rights [including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person’s name, email address, physical address or phone number) or rights of publicity];
• promotes an illegal or unauthorized copy of another person's copyrighted work (see “copyright complaint” below for instructions on how to lodge a complaint about uploaded copyrighted material), such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
• contains restricted or password-only access pages, or hidden pages or images (those not linked to or from another accessible page);
• provides material that exploits people in a sexual, violent or otherwise inappropriate manner or solicits personal information from anyone;
• provides instructional information about illegal activities such as making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses;
• contains video, photographs, or images of another person (with a minor or an adult);

Eligibility
Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use/access the Marketplace. However, if you are a minor, i.e. under the age of 18 years, you may use/access the Marketplace under the supervision of an adult parent or legal guardian who agrees to be bound by these Terms of Use. You are however prohibited (even under provision) from purchasing any product(s) which is for adult consumption, the sale of which to minors is prohibited.
The Marketplace is intended to be a platform for end-consumers desirous of purchasing product(s) for domestic self-consumption. If you are a retailer, institution, wholesaler or any other business user, you are not eligible to use the Marketplace to purchase products from third-party sellers, who have been granted access to the Marketplace to display and offer their products for sale through the Marketplace.
The Organisation, in its sole discretion and without liability, reserves the right to terminate or refuse your registration, or refuse to permit use/access to the Marketplace, if: (i) it is discovered or brought to notice that you do not conform to the eligibility criteria, or (ii) the Organisation has reason to believe (including through evaluating usage patterns) that the eligibility criteria is not met/is violated by a user, or (iii) may breach the terms of this User Agreement.
In order to determine compliance with eligibility criteria, the Organisation inter alia uses an algorithm and/or pre-determined criteria-based technology and accordingly, from time to time, your usage may be restricted or blocked on account of overlap with such algorithms/pre-determined criteria. In such cases, if you are a genuine domestic user of the Platform, please contact us for assistance.

License & Site access
STEMS grant you a limited sub-license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of STEMS. This license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of STEMS. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of the Site or of STEMS and its affiliates without express written consent. You may not use any meta tags or any other "hidden text" utilizing the Site’s or STEMS’s name or trademarks without the express written consent of STEMS. Any unauthorized use terminates the permission or license granted by STEMS.

Account & Registration Obligations
All Members have to register and login for placing orders on the Site. You have to keep your account and registration details current and correct for communications related to your purchases from the site. By agreeing to the terms and conditions, the shopper agrees to receive promotional communication and newsletters upon registration. The customer can opt out either by unsubscribing in "My Account" or by contacting the customer service.

Return & Refunds We have a "no questions asked return and refund policy" which entitles all our members to return the product at the time of delivery if due to some reason they are not satisfied with the quality or freshness of the product. We will take the returned product back with us and issue a credit note for the value of the return products which will be credited to your account Wallet. This can be used to pay your subsequent shopping bills.
GENERAL TERMS AND CONDITIONS
Each member is responsible for remaining knowledgeable about the STEMS program Terms and Conditions and the number of points in his or her account.
STEMS will not be liable or responsible for correspondence lost or delayed in the mail/e-mail.
STEMS reserve the right to refuse, amend, vary or cancel membership of any Member without assigning any reason and without prior notification.
Any change in the name, address, or other information relating to the Member must be notified to STEMS via the Helpdesk/email by the Member, as soon as possible at info@stemsindia.org or call at +918639495626, (10 am to 6 pm) a Day / 6 Days a Week.
STEMS reserve the right to add, modify, delete or otherwise change the Terms and Conditions without any approval, prior notice or reference to the Member.
In the event of dispute in connection with STEMS program and the interpretation of Terms and Conditions, STEMS's decision shall be final and binding.
This Policy and these terms shall be read in conjunction with the standard legal policies of STEMS, including its Privacy policy.

Governing Law and Jurisdiction
This User Agreement shall be construed in accordance with the applicable laws of India. The Court at Visakhapatnam shall have exclusive jurisdiction in any proceedings arising out of this agreement. Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by STEMS and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The arbitration shall be held in Visakhapatnam. The District Court of judicature at Visakhapatnam alone shall have the jurisdiction and the Laws of India shall apply.
